ECHR Issues Nine Decisions in Favor of Citizens of Azerbaijan

 

On 17 September the European Court for Human Rights (ECHR) published a decision on the outcome of 9 cases against Azerbaijan, including complaints of non-execution of judgments in favor of plaintiffs in property cases.

ECHR ruled the cases from the list for consideration, taking into account that the parties had reached a settlement agreement. As a result, Miryusif Agalarov, Fazil Aliyev, Rasim Hajiyev, Alamdar Hasanov, Karim Gurbanov, Arsalam Huseynov, Rafig Dovlatov, Rafig Neymatov, and Tahir Rustamov, whose interests were represented by the Sumgait lawyer Ruslan Mustafazadeh, will receive 3,000 euros in moral indemnity and 400 euros for their costs. At the same time, the complainants withdrew their claims to the government on this issue.

As the Human Rights Centre of Azerbaijan notes, 12 settlement agreements have been made on cases against Azerbaijan in 2015. This accounted for more than half of the decisions taken.

The settlement agreement of the parties is stipulated by Article 39 of the European Convention on Human Rights and provides for removal of cases from consideration in exchange for some steps of the authorities to remedy the violations of the rights of the applicants.
